Scam Victim recovers $21,500 from National Australia Bank

In a significant win, a scam victim receives $21,500 from National Australia Bank due to AFCA’s intervention. The delay in seeking to recover the disputed transaction led to the compensation decision.

In a win for scam victims, National Australia Bank has been required by AFCA to pay a complainant $21,500 for the delay in seeking to recover their customer’s disputed transaction.

AFCA heard the complaint whereby the following facts were considered:

  1. There were three disputed transactions in April, May and June 2022;
  2. The Complainant alleged that the Bank delayed recovery steps in acting on their instructions to recover mistaken transactions;
  3. The Banks delay did not cause the loss in respect of the first two transactions. However, the Bank delayed responding to the recall request in respect of the third transaction.

AFCA held that the Bank had an obligation to issue a recall in respect of the disputed transaction, and had they acted reasonably by pursuing the recall, it is likely that the third transaction of $21,500 would have successfully been recalled.

The Bank was required to compensate the Complainant $21,500, plus interest and $1,500 for non-financial loss.
